Legal Issues: Plaintiff, Daniel Boone, sued defendant; Zoom Car Company for his medical bills resulting from being dragged from his car and beaten when he traveled to a high crime area due to a faulty compass. The plaintiff stated that the reason for this attachment was that the compass installed in the car purchased by Zoom was defective and led him in the wrong direction where he got lost and ended up in a terrible situation which led to the beating. According to the case note, Zoom Car Company produces automobiles; the company installs additional extras and features in their cars. The feature in question was the on-board compass manufactured by Corrigan Rulers Compasses and Slide Rulers Inc. The plaintiff had purchased a car from Zoom which unfortunately had a defective compass installed. The claim here is that the faulty compass is responsible for what happened to the plaintiff. Plaintiff's Arguments Plaintiff may argue that Zoom Car Company should be responsible for his medical bills because what happened was a direct result of the defective compass installed in the car he purchased from Zoom. The plaintiff could argue that the defendant is liable under the Consumer Protection Act on product liability. Product liability is the liability of manufacturers, sellers, and others for damages caused by defective products. The tort principle allows the injured party to file a civil lawsuit to seek compensation for damages caused by defective products. The plaintiff could demonstrate that the defect in the compass was due to the defendant's negligence in Zoom Car Company failing to properly design, test or assemble the compass and in doing so the defendant breached its duty of care to the plaintiff. It is... middle of paper... duty of care to the public to test and ensure that the Compass is in good working order before selling the automobile to the public. Second, assuming the Compass was in good condition before the plaintiff purchased the automobile, it is not possible to prove this in court. In my opinion based on this case, I strongly believe that Zoom Car Company should be responsible for what happened to Daniel Boone considering the fact that the compass installed in the car he purchased was defective and he witnessed the unfortunate accident which could have be avoided by assuming Zoom did its due diligence when installing the compass.
