Topic > Essay on Judicial Review - 2166
In Wheeler it was said that foreign policy was strictly a matter for the central government. By overturning the decision to ban the club, the court placed a limit on the competence of local authorities to make decisions that could influence foreign policy. Some commentators such as Clive Coleman, however, have argued that judicial review does not successfully execute the separation of powers constitution. He said there is a constitutional tension between “a powerful executive, which likes to trample on the constitution, having its way on everything and, on the other hand, a small independent judiciary… which acts well above its capacity”.
